1. ABOUT BALECROW

This website is operated by Balecrow LLC, doing business as BALECROW (“we,” “us,” or “our”). These Terms govern your use of balecrow.com and purchases from our store.

Our store is hosted by Shopify. Purchases are made directly from Balecrow LLC.

By using our website or placing an order, you agree to these Terms. Nothing in these Terms limits consumer rights that cannot legally be waived.

1. ELIGIBILITY AND WEBSITE USE

You must be legally able to enter into a binding agreement or use our store with the involvement of a parent or legal guardian.

You agree to provide accurate contact, billing, payment, and shipping information. If you use a customer account, you are responsible for protecting access to it.

You may not use our website for unlawful purposes, submit fraudulent orders, upload malicious software, infringe another person’s rights, or attempt unauthorized access to our systems or customer information.

1. PRODUCTS AND LIMITED RELEASES

We make reasonable efforts to describe and display our products accurately. Screen settings may affect how colors appear. Garment washes, print placement, and finishes may vary slightly between individual pieces. These variations do not excuse a materially inaccurate description or defective product.

Products are subject to availability. Adding an item to your cart does not reserve it. Limited releases may sell out, and restocks or replacement sizes are not guaranteed.

Limited quantities or discounted prices do not automatically make an item final sale. Any final-sale condition will be disclosed before purchase and will not override applicable rights concerning defective, incorrect, or misdescribed goods.

Preorder and made-to-order items, when offered, will be identified before purchase with their expected shipment timeframe.

1. PRICES AND PAYMENTS

Prices are shown in the currency displayed at checkout. Applicable shipping charges and taxes collected by us are displayed before payment.

Prices and promotions may change for future purchases. We will not increase the price of an existing order without your agreement.

You represent that you are authorized to use the payment method provided. Payment must be authorized before we process your order.

Promotions may have additional terms disclosed with the offer.

1. ORDER ACCEPTANCE AND CANCELLATIONS

An order confirmation acknowledges receipt of your order. We may decline or cancel an order for a legitimate reason, including unavailable inventory, suspected fraud, payment problems, or an obvious pricing or listing error.

If we cancel an order after payment, we will notify you and refund the canceled portion, including applicable taxes and associated shipping charges.

To request an order change or cancellation, email balecrowllc@gmail.com promptly with your order number. Changes may not be possible once fulfillment or shipment has progressed. This does not limit cancellation rights provided by law or our shipping-delay procedures.

1. SHIPPING AND DELIVERY

The shipment timeframe stated before purchase applies to your order. If no shipment timeframe is stated, we will ship within 30 calendar days after receiving your completed order and payment authorization, or provide the required delay notice and cancellation options.

If we cannot ship on time, we will notify you before the applicable deadline, provide a revised shipment date when available, and explain your option to cancel for a refund of the unshipped portion.

We will request your express agreement to a revised shipment date. If you decline or do not agree by the response deadline in our notice, we will cancel and refund the unshipped portion. Additional delays require a further notice and agreement.

Refunds for canceled, unshipped merchandise include applicable taxes and associated shipping charges and will be issued promptly within applicable legal deadlines. We will not substitute store credit for a required refund.

Carrier transit estimates are separate from order processing. Delivery dates are estimates unless expressly guaranteed. Carrier delays do not eliminate your statutory rights.

For missing, damaged, or incorrectly delivered orders, contact us so we can investigate and arrange an appropriate resolution. A delivery scan does not automatically close a missing-package claim.

1. RETURNS AND REFUNDS

That policy explains return eligibility, deadlines, shipping responsibilities, exchanges, and refund procedures. Please contact us before returning merchandise so we can provide the correct instructions and return address.

Replacement items and alternative sizes depend on availability. Nothing in our return conditions limits mandatory rights concerning defective, incorrect, or misdescribed products.

The registered/principal office listed below is not a merchandise return address.

1. EMAIL AND SMS MARKETING

Marketing subscriptions are optional. Consent to receive marketing is not a condition of purchase.

Providing a phone number for an order or customer-service inquiry does not by itself enroll you in SMS marketing. Email marketing consent does not constitute SMS marketing consent.

By separately opting in to BALECROW SMS marketing, you agree to receive recurring promotional text messages, which may be sent using automated technology, at the number you provide. Messages may include product previews, launch announcements, restock updates, and offers.

Message frequency varies. Message and data rates may apply under your mobile carrier’s plan.

To unsubscribe from SMS marketing, use the unsubscribe link included in our texts. For help or assistance unsubscribing, email balecrowllc@gmail.com. You may unsubscribe from promotional emails using the unsubscribe link included in those emails.

Unsubscribing from marketing does not prevent necessary non-promotional communications about your purchases.

You must provide a number you own or are authorized to use. If you stop using that number, please unsubscribe or contact us to update your information.

Message delivery depends on carrier and network availability and is not guaranteed. Carriers are not liable for delayed or undelivered messages.

1. INTELLECTUAL PROPERTY

BALECROW’s name, logos, original designs, photographs, text, and other protected materials are owned by Balecrow LLC or used with permission.

Purchasing a product does not transfer intellectual property rights. You may not reproduce, distribute, or commercially exploit protected materials without permission, except as permitted by law.

Nothing in these Terms restricts rights you may lawfully exercise, including fair use.

1. CUSTOMER SUBMISSIONS

You are responsible for ensuring that reviews, photographs, and other content you submit do not infringe anyone’s rights or contain unlawful or misleading material.

If you submit a review or other content for public display on our store, you grant us a nonexclusive permission to display and reproduce it for that purpose. Private customer-service communications are not automatically authorized for advertising use.

1. THIRD-PARTY SERVICES

Our website may include links or access to independent third-party services. Those services may have their own terms and privacy policies.

Shopify provides the technology supporting our store. Balecrow LLC remains responsible for its customer orders and obligations as the seller.

1. WEBSITE AVAILABILITY AND LIABILITY

We take reasonable steps to maintain our website but cannot guarantee uninterrupted or error-free access.

To the extent permitted by law, Balecrow LLC is not liable for indirect or consequential losses arising from use of the website.

Nothing in these Terms excludes liability that cannot lawfully be excluded, removes applicable product warranties that cannot be waived, or limits mandatory rights to refunds, replacements, or other remedies.

1. PRIVACY

Our handling of personal information is described in our Privacy Policy. If these Terms conflict with that policy regarding personal information, the Privacy Policy controls on that issue.

1. GOVERNING LAW

These Terms are governed by Wisconsin law, subject to mandatory consumer protections that apply where you live.

Nothing in these Terms removes any right you have under applicable law to bring a claim in a competent court in your place of residence.

1. CHANGES TO THESE TERMS

We may update these Terms by posting a revised version and updating the date above. Changes apply prospectively, and we will provide additional notice where required.

An existing purchase remains subject to the terms applicable when the order was placed, except where otherwise required by law or agreed with you.

If any provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
